What's at stake if Tom Brady and Gisele Bundchen divorce?
What's at stake if Tom Brady and Gisele Bundchen divorce? Page Six reported in October 2022 that Brady and Bundchen had hired divorce attorneys following their split following a dispute over Brady's departure from the NFL and his decision to return to the Tampa Bay Buccaneers three months after announcing he was done with football . "I never thought this fight would be the end of them, but it looks like it," a source told Page Six at the time. "I don't think there will be a return now. They both have lawyers and are looking at what a split will entail, who gets what and what the finances will be like.”
A source also told People at the time that Brady was "trying to figure out what to do" after learning that Bundchen had hired a divorce lawyer. A source also told Us Weekly at the time that Bundchen - who was "living apart" from Brady when she hired her divorce attorney and was "at odds" with her husband for months - was waiting for a "grand gesture" from him. after learning that her thoughts about divorce were serious. "Gisele is waiting for Tom to make a big gesture of support for her," the insider said.
Chemtob Moss Forman & Beyda LLP attorney Sue Moss, who is not affiliated with the couple, also told People in October 2022 that Bummel and Brady's income differences could complicate their divorce. "The big challenge for him is that everything will be decided at the peak of his earnings because to get him to come back the Tampa Bay Buccaneers had to raise a lot of money - and that's the basis for determining support in this case." said Moss. "In the beginning, Gisele was making more than he was, and he kept winning and his income became more substantial and outgrew hers. And because of the timing, the case will be decided on the basis of merit.”
Divorce attorney Jacqueline Newman of Berkman Bottger Newman & Schein LLP, who is also not affiliated with the couple, also speculated to People that Brady and Bundchen signed a prenup because of their wealth. "People of that magnitude don't generally get married without a document dictating what will happen if it doesn't run its course," Newman said. “I suspect a lot of that has already been worked out. So there's probably a prenuptial agreement that's going to dictate a lot of that, but if there's some property that was bought while they were married - matrimonial homes - there can be arguments about that." Newman continued, "There were probably assets that acquired during the marriage, so there can be some quarrels about it, to say the least. Still, I think they'll sort it out, provided they keep going - outside of the press."
At the time they were hiring divorce attorneys, Brady and Bundchen owned at least four: a home at the Yellowstone Resort in Montana; a $3.5 million condo in New York City; a home in Costa Rica; and the $17 million mansion on Indian Creek Island in Miami. While Brady and Bundchen's finances are complicated, Newman speculated at the time that child custody could be a bigger issue. "It really seems like [Bulpen] dedicated her life to these kids," Newman said. "I'm sure he's devoted to the kids, but he travels a lot. He is not so involved in everyday life. Maybe she wants more stability for them." Newman continued, "The worst thing they can do is put their kids through a custody battle."
